Prior to safety standards being enacted in 1972 by the Occupational Safety and Health Administration (OSHA), many tire plants used machinery to build products that contained asbestos fibers. Additionally, some tire plants exposed workers to asbestos-wrapped pipes.
Thankfully, the family of a Tyler man who worked at a Kelly Springfield/Goodyear plant was awarded $18.6 million by a Dallas County jury recently, after the man died from mesothelioma in 2009.
According to the Tyler Morning Telegraph, Carl Rogers worked at the plant for 30 years, where he was exposed to asbestos fibers. His estate’s attorneys argued that the plant ignored regulations, allowing him to be exposed for extended periods. Rogers was a tire builder and was diagnosed with mesothelioma in 2008, dying shortly after.
The jury awarded his family $2.7 million in non-economic damages, $900,000 in economic damages and $15 million in punitive damages.
It was argued during his trial that Rogers was exposed to asbestos levels that were “10 to 100 times greater than the average person would breathe outside the plant.”
